Welcome to Sooqna! These Terms of Use ("Terms") govern your access to and use of our platform, services, and features (collectively, the "Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, please refrain from using Sooqna.

1. Acceptance of Terms

By using Sooqna, you confirm that:

1.1. You are at least 18 years old or legally capable of entering into contracts under the laws of the United Arab Emirates.

1.2. You accept these Terms and any other policies referenced herein, including our Privacy Policy and Cookies Policy.

1.3. You will comply with all applicable laws and these Terms when using the Platform.

2. About Sooqna

Sooqna is a peer-to-peer marketplace designed for buying and selling pre-owned and new home items. We provide:

2.1. A platform for sellers to list items and buyers to browse and purchase them.

2.2. Logistics services, including pickup, delivery, and dismantling/assembly of furniture if needed.

Note: Sooqna does not own or guarantee the items listed by users and acts solely as an intermediary.

3. User Accounts

3.1. To use the Platform, you must create an account and provide accurate, complete, and current information.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. Notify Sooqna immediately if you suspect unauthorized access to your account.

4. Listing and Selling Items

4.1. Sellers may list only eligible items, including furniture, decor, and other home-related goods. Prohibited items include:

• Illegal or hazardous goods.

• Appliances, and any items outside the home category.

4.2. Items must be accurately described with clear photographs, including visible defects.

4.3. Sooqna reserves the right to:

• Remove any listing that violates these Terms or doesn’t match the Sooqna Curration Standards.

• Deduct partial refunds from sellers if items are misrepresented once they are sold and inspected by the Buyer.

5. Buying Items

5.1. Buyers are responsible for reviewing item descriptions and confirming all details before purchase.

5.2. All sales are final unless an issue is reported within 24 hours of receiving the item.

5.3. Issues such as misrepresentation or defects will be addressed case-by-case. If Sooqna approves a return:

• The buyer bears all return costs.

• Returns must be facilitated through Sooqna’s logistics services to maintain user privacy.

6. Returns and Refunds

6.1. Items are sold "as-is," with no warranties or guarantees.

6.2. Returns are only permitted under the following circumstances:

• The item received is materially different from the seller’s description or photographs, as defined below:

  • The item is a different type or model than listed.

  • The item has a defect or damage not disclosed in the description or shown in the photographs, and such defect or damage results in a material deviation from the overall condition described by the seller, such as a large, visible stain, a deep scratch, or broken components; and could not reasonably have been identified by the buyer based on the photographs and description provided in the listing.

• The item is missing essential components or parts that were not disclosed in the listing and are necessary for its intended use.

6.3. Sooqna will inspect returned items and decide on refunds or replacements at its sole discretion.

6.4. Process for Reporting Issues

• Buyers must report any issues with the purchased item to Sooqna within 24 hours of receiving it. Reports submitted after the 24 hour period will not be considered.

• Reports must include:

  • Clear photographic evidence of the issue.

  • A detailed explanation of how the item deviates from the seller’s description or photographs. Reports submitted after the 24-hour period will not be considered.

6.5. Return Authorization

• Upon receiving the buyer’s report, Sooqna will review the issue and determine whether the item qualifies for a return based on the criteria outlined in this policy.

• If a return is approved:

  • Sooqna will coordinate the logistics of the return.

  • Buyers must use Sooqna’s logistics services to ensure the privacy of sellers and proper handling of the item.

• Buyers are responsible for all costs associated with the return, including pickup, delivery, and dismantling/assembly fees.

6.6. Exclusions from Returns

• Returns will not be approved for the following:

  • Minor wear and tear consistent with the item’s age and prior use.

  • Variations in color, appearance, or texture due to photography or screen settings.

  • Any issues that were disclosed in the listing description or photographs.

6.7. Seller Responsibility

• Sellers are obligated to:

  • Accurately describe items, including any known defects or damage.

  • Provide clear and truthful photographs of the item.

• If a return is approved due to a seller’s failure to disclose defects or damage, Sooqna reserves the right to:

  • Deduct the full refund amount from the seller’s payout; or

  • Recover funds from the seller if the payout has already been issued.

6.8. Discretionary Approval

• In cases of dispute, Sooqna retains sole discretion to determine whether an item qualifies for a return or refund under this policy.

• All decisions made by Sooqna regarding returns and refunds are final and binding.

7. Fees and Payments

7.1. Sellers are charged a percentage of the transaction value, which includes Sooqna’s commission and payment processing fees.

7.2. Buyers are charged a service fee and a delivery fee as part of their transaction.

7.3. Fees for optional services, including dismantling, assembly, and storage, are calculated based on the specific service requested. These fees will be disclosed to the User before confirming the service.

7.4. VAT and any other applicable taxes will be applied in accordance with the laws of the United Arab Emirates. Users are responsible for any additional taxes or duties that may apply based on their location or circumstances.

7.5. All payments, including fees and commissions, are processed securely through Stripe, a third-party payment gateways. Users agree to abide by the terms and conditions of the payment processor used by Sooqna

8. User Conduct

When using Sooqna, you agree to:

• Refrain from posting fraudulent, misleading, or harmful content.

• Respect other users’ privacy and refrain from disclosing personal information.

8.2. When using Sooqna, you may not:

• Use Sooqna for illegal activities.

• List prohibited items or misrepresent listed goods.

• Attempt to bypass Sooqna’s payment or logistics processes.

8.3. Failure to comply with these terms or any misuse of the platform may result in Sooqna suspending or permanently banning your access to the platform.

9. Liability

9.1. Sooqna is not responsible for:

• The condition, authenticity, or legality of items listed by users.

• Disputes arising between buyers and sellers.

9.2. By using the Platform, you agree to hold Sooqna harmless from any claims, damages, or losses related to your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless Sooqna, its affiliates, and its employees from any claims, liabilities, or damages arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

Sooqna reserves the right to suspend or terminate your account if you:

11.1. Breach these Terms.

11.2. Engage in fraudulent, harmful, or illegal activities.

11.3. Misuse the Platform or its services.

12. Governing Law and Dispute Resolution

13.1. These Terms are governed by the laws of Dubai and the United Arab Emirates.

13.2. Any disputes shall be resolved exclusively in the courts of Dubai.
